Timely filing of trademark renewals is crucial to maintaining your trademark rights. Even if your trademark has been in use for years, missing the renewal deadline can result in the USPTO canceling your registration.

Trademark Renewal Deadlines

Between the 5th and 6th years after registration, the USPTO requires proof of continued use of the trademark in commerce. This is known as the “Section 8 Declaration of Continued Use.”

Between the 9th and 10th years after registration, the second renewal must be filed.

After the 10th year, renewals must be filed every 10 years.
